CLEARY UNIVERSITY RESIDENCE HALL CONTRACT


OVERVIEW:  The CLEARY Student Housing Contract requires students to sign this Student Housing Contract as follows:


CLEARY Student Housing Contract (“Contract”):  The Student Housing Contract is a financially and legally binding contract between the Cleary University and a prospective or enrolled student who is and intends to remain enrolled.  It is a contract for the use of space and all terms including length of contract, cancellation terms and other terms set forth will be enforced.  (Special Status Students are housed upon approval by the Department.) Any alterations by the student to the terms contained in the contract will neither be honored nor deemed valid without specific written approval from the • Director of Housing recognizing acceptance of and identifying the proposed alterations.   By signing the Contract, electronically or otherwise, the student is acknowledging notice of all of the Student Housing Contract terms. If you fail to check into your space on the assigned move-in day, your contract will be cancelled. Individuals that fail to move-in will remain financially responsible for payment.

ACCEPTANCE OF CONTRACT TERMS AND CONDITIONS: 


This is a Residence Hall and Meal Plan Contract made between the undersigned student and Cleary University. You are advised to carefully review this legally binding contract as well as all policies in the Cougar Resident Guide located at www.cleary.edu. By signing this contract, you affirm that you have read and agree to abide by the terms and conditions outlined in this contract, and all the rules, regulations and policies pertaining to the Cougar Resident Guide. Failure to abide by any other housing or student policy can and will result in removal from housing. By signing this document, the student hereby agrees to accept these conditions as outlined in this contract.

 

Definitions: All references to the term Department are understood to mean the Director of Housing or designee; all references to the Director of Housing are understood to include a designee. All references to the term residence hall(s) are understood to include all housing options available at Cleary University. The following rights and responsibilities apply to assignment, utilization and contract. 

 

Length of Contract: Length of Contract: The contract dates covered by these terms, conditions, and responsibilities are Spring semester selected above OR Fall semester thru Spring semester selected above. The dates for each semester are available on the Cleary website at Cleary.edu.

 

Consideration: In consideration of the payments made and to be made, as provided herein, the student is entitled to occupy an assigned space and to the services provided by the Director of Housing, all subject to the terms and conditions included in this Contract. 

 

Effective Date: The contract, when appropriately submitted with required application payment, becomes effective upon the date of assignment and it remains valid until the end of the contract period. Once assigned, the student is fully responsible for all required payments and lawful charges as set forth in the contract including all cancellation costs. Students are responsible for printing their own copy of the contract.

 

Meal Plan: All Residential students residing on campus are required to purchase a meal plan.  More information on meal plan details can be found at Cleary.edu

 

Meal Card: Your meal plan card may be used for food purchases only at the designated Cleary University eatery and may not be exchanged for cash. Your card is non-transferrable, non-assignable and meals expire at the end of the semester. Unused meals are NOT refunded and do NOT carry over from semester to semester. You must present your card to get a meal.

 

HOUSING REQUIREMENTS: All residents must maintain full-time student status (12 credit hours), and participate in a meal plan while residing in campus housing. If students fails to meet these requirements at any time, they may be removed from campus housing. Please note in Spring/Summer semester full time is considered six credit hours. Compliance with these terms conditions, rules, regulations and policies is a condition of this contract.

 

Housing Eligibility: Notification of acceptance to the University by the Admissions Office does not constitute acceptance of a Housing Contract nor does it guarantee space will be available. The prospective or enrolled student is considered eligible for a residence hall space when all of the following conditions are met; the prospective or enrolled student submits the contract with required application and housing application fee.  Students are required to have a payment plan for room and board prior to moving into assigned space.

 

Specific Space Assignments: Acceptance of the contract does not guarantee assignment to a specific building, room, roommate, or room type (double or triple occupancy).  The Department reserves the right of room consolidation, change the room’s gender designation, occupancy designation, or change in the assignment either in advance of check-in or after the start of the term. If one of the occupants of a double occupancy or one or two of the occupants of a triple occupancy room moves out, the Department will assign an occupant(s) to that room. If the Department can make no such assignment, upon notification, the remaining occupant will be reassigned to a room chosen by the Department. The Department may take no action.  

 

Student Occupancy: Only the student to whom it is contracted may occupy Residence Hall space. The contract may not be re-assigned, and residence hall space may not be sublet to another person. 

 

Transfer or Reassignment of Space: 

The student may, after written approval from the Director of Housing and/or their designee, move to another residence hall space at the discretion of the Director of Housing. 

Disabilities and Facilities: Varieties of facilities are available for students with disabilities and other medical considerations in on-campus housing.  Students requesting reasonable accommodations for housing based on a disability or a medical condition must submit their request for said accommodations in writing to the Director of Housing by June 1 for the fall or as soon as reasonably possible after a condition occurs.  Housing staff will confer with the Director of Housing in order to determine any reasonable and appropriate accommodations.  Any information provided to Cleary University substantiating a disability or medical condition will be maintained in strict confidence.

 

Department Cancellation: The Department may initiate reassignment or cancel the contract with any and all applicable charges if deemed necessary by the University in the best interest of order, health, discipline, safety, security, disaster, failure to make required payments according to Payment Schedule. The Department may also cancel a contract for any individual whose enrollment status changes (including but not limited to a voluntary withdrawal, dismissal or change in full time status) over the term of the contract.  Students whose contract has been cancelled will be required to vacate the residence halls within 48 hours from notification unless otherwise indicated. 

 

Maintenance and Damages: Residence hall spaces are to be kept clean and orderly by the student at all times and are to be used for residence only. Charges will be assessed for damages to, unauthorized use of, or alterations to any assigned spaces, equipment or buildings, and/or for special cleaning of assigned spaces necessitated by student negligence. Resident students are jointly and severally responsible for the care of any common areas or equipment.  Excessive damage, as determined by the Director of Housing, may incur, in addition to charges for restitution, removal from the residence halls in compliance with the policies outlined.

 

Damage Liability: The University is not liable for damage to or loss of personal property, failure or interruption of utilities (including internet access), or for injury or inconvenience to persons except as may be required by local statute. Students are encouraged to provide their own personal property loss insurance.

 

Modification of Rules and Regulations: The University reserves the right to make additional and/or modify existing rules and regulations. The Department agrees to make reasonable effort to inform resident students of any regulation changes or pertinent policy information.

 

Provisional Removal for Behavior: Resident(s) who have been determined to create an immediate danger or threat to the community may be provisionally removed from Cleary Student Housing until an investigation and a resolution can occur.  This authority shall rest with the Director of Housing. Residents will remain financially responsible for the contract during the provisional removal.

 

Student Code of Conduct: Students are responsible for knowing and observing University regulations and policies as outlined in the Student Rights, Responsibilities, Code of Conduct Policy, and Cougar Resident Guide. 

 

 

RATES AND PAYMENT:

Payments by check, cash, or money order are to be payable to: Business Office, Cleary University, 3750 Cleary Dr., Howell, MI 48843

 

Residence Life Fees:

Cleary 1 Card (per key not returned, replacement key) – $25.00

Room Key in South Hall (per key not returned; lost; duplicate key, replacement) – $25.00

Trash left in room (minimum charge) – $50.00

Excessive Housekeeping required, as deemed by Facilities Department- $100.00

Improper Check-Out- $50.00

Staying beyond Finals Week: $50.00 per day

 

Occupancy Status: Occupancy occurs when a student officially receives the keys to the room or is officially checked-in via the student housing software.  If either condition exists, then the room is considered officially occupied.  Occupancy will remain in effect until the same procedure is followed to checkout of the space.  Removing personal belongings and vacating the assigned space will be considered an improper checkout and the student will be financially responsible for the terms of the contract and associated fees.

 

Housing Cancellation prior to move-in: you choose to terminate your contract prior to move-in you remain responsible for a $300 cancellation fee. Cancellation requests must be submitted in writing no later than 30 days prior to move-in to the Department.

 

Failure to move-in: If you fail to move-in after submitting your contract and your room has been assigned you will remain responsible for a $300 cancellation fee.

 

No Shows: Residents who have not properly occupied their room by 12 p.m. on the first day of classes and have not notified the Department of their late arrival may be declared “no shows” and be reassigned based on availability of bed space. If the student is found to be not enrolled, the student shall be charged a $300 cancellation fee.

 

Cancelling Housing after move-in: Students wishing to cancel their contract after moving into the residence halls may do so by paying a prorated fee for time assigned to the room, plus the $300 cancellation fee.  The fees will be added to the student’s financial account.  Non-payment of the fees may result in a student registration hold or restriction on graduation and ability to obtain a transcript.

Housing Application Fee

To apply to live on campus at the Cleary University Livingston Campus, please complete this application.  You must acknowledge that you have read and understand the Housing Policy.
Acknowledgment of Housing Fee

A limited amount of housing space is available for those student requesting on-campus accommodations.  Housing contracts will be accepted on a space-available basis.  Contracts that are received after on-campus housing is filled will be placed on the on-campus housing wait list.

Application Fee: Upon submission of this application, the student account will be assessed a non-refundable application fee of $100.  Assessment of this fee does not imply the contract is complete or that the student has been approved. Once this form is completed you will be redirected to a payment page for your student housing application fee.  Once your fee is paid and accepted you will receive the Cleary University Student Housing Contract.  The Student Housing Contract must be completed to be considered for a room assignment. 
2. Length of Contract: The contract dates covered by these terms, conditions, and responsibilities are Spring 2021 OR Fall 2021 semester thru Spring 2022 semester.  The dates for each semester are available on the Cleary website at Cleary.edu. 
3. Effective Date: The contract, when appropriately submitted with required application payment, becomes effective upon the date of assignment and it remains valid until the end of the contract period. Once assigned, the student is fully responsible for all required payments and lawful charges as set forth in the contract including all cancellation costs. Students are responsible for printing their own copy(ies) of the contract.
4. Meal Plan Requirement: All Residential students residing on campus are required to purchase a meal plan.  More information on meal plan options can be found at Cleary.edu
5. Agreement:  By signing this agreement, the student hereby contracts for a space in a Cleary University Student Housing building and agrees to room charges and meal plan at the rates established by the University. By signing this agreement, the student understands this agreement may not be terminated unless the student withdraws from the University. All students not abiding by the residence requirement are still subject to room and board charges. More specific housing regulations and policies are contained in the Student Housing Handbook.
